with police. one suspect was arrested, another still on the loose. cbs 5 reporter anne makovec is in san jose with the latest. >> reporter: the city is reeling from this crime, actually spanning several crime scenes. one of them behind me broken glass from the shootout with police in this intersection. the police officer who was shot is okay. but a gunman is still on the loose. >> our primary focus is getting the second guy in custody. >> reporter: after a chase by car and on foot this is how it ended for one of two men accused of shooting a police officer in san jose last night hiding in a neighborhood that spent two hours on lockdown. >> you know, it was crazy and it was scary. it was scary. >> reporter: police say the men went on an armed robbery spree yesterday hitting up businesses and people at gunpoint in all four of these locations. police are also looking into the possibility that the two were involved in a murder. >> very violent suspects. they were both armed with firearms. and we had a pretty good idea of what the vehicle looked like. >> reporter: police spotted it on highway 101

out here in the midtown section of san jose. this is near the corner of fruitdale avenue and lee avenue, where at 8:30 a fire broke out at the upper level of this apartment complex. someone was burning a fire in their fire place. it very quickly went to three alarms. the firefighters arrived, sprayed a lot of water on it. that's when they did an interior attack. one of the captains went inside and the roof partially collapsed on this captain, knocked him down. he suffered relatively minor to moderate injuries. they're not sure at this point. he went to the hospital. but six units were evacuated. six families had a very rough thanksgiving. we talked to one man. >> this is one heck of a thanksgiving for you, huh? >> yes, sir. but on the good side, my family is okay, and that's what i'm thankful for. it's a really bad feeling but we're okay, and that's the most important thing. >> reporter: fantastic attitude on this holiday. a lot of these firefighters are now in the mop-up phase. again, a three-alarm fire, nobody hurt except for that one firefighter. live in san jose, kiet do, cb

-old from san jose will be eligible for the death penalty. it habit yet decided whether to seek putting him on death row. he is due in court tomorrow on a list of charges including murder, robbery and attempted murder of a police officer. he and a 26-year-old man robbed four businesses earlier this month and shot a campbell man as they were trying to car jack him. they shot and wounded a san jose police officer. the man who fired the shot is still at large. luckily the officer wasn't hurt and doesn't know if he wounded the suspected. investigators say he pulled over a tan 1996 honda. the car was later found nearby and turned out to be a stolen vehicle. >> it's a bizarre crime. two men pointing a gun. those men have been arrested now. both of oakland. they were taken into custody last night. cell phone video seen right here shows that when the incident started around 4:00 yesterday afternoon, the two men were driving erratically on high street in oakland. a couple in another car started recording them to report to police. the men noticed this and then tried to get the phone, but were unsucce

san jose to explain what happened in the shooting of a marine in san jose in palm springs. >> reporter: well, this marine attended piedmont high school here in san jose his sophomore and junior here and then transferred out. are calling this a tragedy. here is picture of him. 22 years old. he was stationed out of 29 palms. police in palm springs say two bicycle officers heard yelling in a parking garage and when they entered, they recognized him and his marine friend from a public intoxication from earlier that night and the men started to yell derogatory comments. one of the officers reached in the car. >> the suspect accelerated directly toward the other officer. >> reporter: the officers both fired their weapons and shot him which resulted in his death. the passenger was uninjured. the marine's family told me on the phone he's a good man who served in afghanistan. they say what police is describing is completely out of character. there's an american flag and patriotic stickers. neighbors say the family was also -- the family was always proud of him. >> you think you ar
